Ok, so I traded my car on the 8th. Got a title and everything, signed it, blah blah blah. So on Wednesday I went to get my tag, and the DMV lady tells me that there is a newer title floating around for this car. The one I have was issued in October 08, she is saying that another was issued in December 08.

Here's where it get's really terrible. Apparently, the guy I got it from didn't even own the car. He bought it from someone else and just never signed the title. So I finally get in touch with the actual owner, and at first he was being helpful and shit. Now he won't call me back or answer my phone calls. Keep in mind that the guy I got it from and actual owner know each other.

So essentially, I gave my old car away and now I have a new one that legally isn't even mine. Any advice on what course of action I should take from here?

I do, but the guy I got the car from signed it, and he technically never owned the car.

OK, since you didn't want to private message me on this I'll put it here.

You have a signed bill of sale and a title. The guy who "sold" you the car didn't have the right to sell it to you in the first place. This can mean a couple things. First, what did you pay for the car?

I've never dealt with this exact issue, but I've dealt with enough people who've tried to screw me, and I always end up winning. Well one time I didn't but that was my fault.

Captain, If all fails The Obvious solution would be to stab his ass in the jugular.

The guy who sold you the car can be fined BIG TIME!!! He technically can only sell you the car with a power of attorney which I doubt he has. If they can prove that he made profit on the car, that's another offense.

The whole "you can sell 3-5 cars per year without being a dealer" is an urban legend. you can sell ZERO per year for profit w/o being a dealer.

Sounds like the title you have was reported lost.

The owner can go to the courthouse with you to confirm that it was sold to you (forgot the name of the form)

same thing happened to me with one of my mini's called the actual owner and he actually got a title and sent it to me. hope it all works out for you if not pm me and we'll go take care of it! people have tried to eff me over aswell

Ok, so Person B I got the car from called me, he said he was on the way to person A's house to straighten shit out. Hopefully he can help me.

Small claims court, get them served, its 75 bucks. Usually does wonders for people once they think they are going to have to go before a judge and try to get out of it.

Ok, I threatened them both with legal action. And person B got a title from person A and gave it to me. It's dated Aug 28 2009. So he obviously got another title issued on friday and gave it to me. We'll see later on today when I go to the DMV if it's legit.

But if I were you I'd be going to the police and having them put some sort of note on the VIN of the car you traded so that the new owner cannot register the car until you get a LEGIT title for the new car.

edit: or just tell the guy you're going to report the car stolen and say the title was in the glove box :rolleyes: just to scare him a little bit.

If you go to the State office and pay extra they'll give you one on site.

I bet the guy misplaced the original title, had a new one issued, misplaced the new one and just assumed it would be ok to use the old one.
