Well, I was at this club the other night, Yes Im underage. Im the bathroom this bouncer said he would sell me a 21+ band and 3 VIP bands, so i did. Im up in VIP and one of the girls im with takes a sip of my drink then they come and tell both of us we have to leave. on the way to the stairs from VIP I said "I understand your on a powertrip" then the motherfucker pushes me down the stairs. We get to the bottom and im looking around for him and he pushes me in my face (pussy), does it one more time and then I get swooped up by this big ass dude, thrown out this door onto a dumpster with my neck on the edge. Im now handcuffed by the bouncer and i cant breathe with my neck on the edge. So i say "I cant breathe homie" and he punches me in my face 3 times. HAHA, so now I have a black eye and some other various things. Cops talk to me and say if im pressing charges they are gonna take me to jail, and if im not they will let me go home, so I went home.
What would YOU do?

you could admit to underage consumption, lose your license, pay fines, and have a record, or you can let a black eye heal. Sounds like a very cheap way to learn a lesson.

I had a similar situation.. The cops there are corrupt.. The bouncers get you arrested for anything... They are power tripping losers..
The club hires these off duty officers, and since they pay them, the club/bouncers are above the law and tell the cops what to do..

should have pressed charges, if you used your valid ID to get in, but somehow ended up with 21+ vip passes and drinks. Not your fault, clubs fault to improperly check ID, allowing a underage to drink then using unnecessary force when you were not resisting. Yea the club got money, but if you have good enough lawyer the club will mostly likely try to settle it. All cops are hired by the clubs, and are pretty much working for them if they are standing infront of it. Public means shit to them then.
Edit saw it was opera. Didn't have a bad experience there, but they everyone from owner to bouncers aren't afraid to show power.

I am with izzy just because i have seen plenty of these cases out in cali its like a everynight thing up there.And regaurdless if they let the bouncer go or not it still is on the employer because at the time of the accident he was employed by them.Call it what u will but with a great lawyer and if you got deep pockets u can make a nice case and change the name of the club to your own:)

I wonder what is being left out, I know bouncers love to fuck someone up whenever the chance presents itself. But most of the time its the clubgoer that either says something or does something to provoke the bouncer's action. Gl on the lawsuit, I hope you atleast got checked out by a doctor as soon as this happened so its documented

All in all bouncer sold it to him but did not force him to use it. He is still wrong. He drank, he got shit kicked out of him. Tough lesson.

I can honestly say, I did NOT lay a hand on anyone, or even try to resist, ofcourse I was trying to get up while I was getting punched in the face, handcuffed. But I was unsuccesful

I would sue. I would list the club as a plaintiff as well as the body guard and the cop. Even if the club lets the employee go, he was still working their so they would be responsible also. Make sure you take plenty of pictures, also go file a police report. I would acknowledge too the cops someone else was drinking and you weren’t the one, that they where kicking your group out.
Most clubs carry insurance for stuff like this I’m sure the insurance company would step in and take care of you.
I think its funny how most on IA say it was your fault. Get serious, everyone drinks before they are 21. So no reason to jump his ass over it.

You realize that like B18 said clubs carry heavy insurance. They also have LOADS of high end video cameras! They would have him on video wearing a over 21 braclet, there fore Underage Possesion. He could argue that someone sold it to him, but that would just put more dis-credit against him. Underage Possesion is a automatic 6-12 month suspension of ones license.
I agree with B18 that everyone under 21 drinks, but least most are not dumb enough to do it or try it in a place that will most likely get you caught!

Heck if he didn't report it that night....i don't even see him able to prove he got beat by security. Then comes up with "i can say Opera Bouncer did all this." Who is to prove me wrong? Documentation?

Wow first time I can quote you and agree. Hell even better to throw in the mix what if the bouncer that sold him the band was actually a cop? His ass would have been arrested on the spot. He goes to court he has to admit to commiting fraud to obtain the drinks. At that point all credability is lost with what ever he says. Past there club can turn around and counter sue for harrassing them and for court cost. So then you would be looking at a possible counter-lawsuit + if the judge wants to fine you or punish you for possesion of alcohol as a minor!
Just chalk this up as a very very hard lesson learned.

Well shit I was wrong to one extent. It would matter if he was driving the vehicle at the time. But the court could still argue he obtained alcohol at the club and then drove home after getting thrown out, could cause some issues.
(2) For purposes of this chapter, an accepted plea of nolo contendere to any violation of Code Section 40-6-393 or 40-6-394 shall constitute a conviction.
(e) The driveŕs license of any person under 21 years of age who is convicted of unlawful possession of alcoholic beverages in violation of Code Section 3-3-23 while operating a motor vehicle may be suspended for a period of not less than 120 days. At the end of 120 days, the person may apply to the department for reinstatement of said driveŕs license. Such license shall be reinstated only if the person submits proof of completion of an approved DUI Alcohol or Drug Use Risk Reduction Program and pays a restoration fee of $35.00 or $25.00 when processed by mail. For purposes of this subsection, a sentence under subsection (c) of Code Section 3-3-23.1 shall not be considered a conviction, and the driveŕs license of such person shall not be suspended, provided that such person completes a DUI Alcohol or Drug Use Risk Reduction Program within 120 days after sentencing.
This is what you would face if charged with underage possession.
3-3-23.1.
(a) It is unlawful for any person knowingly to violate any prohibition contained in Code Section 3-3-23, relating to furnishing alcoholic beverages to, and purchasing, attempting to purchase, and possession of alcoholic beverages by, a person under 21 years of age.
(b)(1) Any person convicted of violating any prohibition contained in subsection (a) of Code Section 3-3-23 shall, upon the first conviction, be guilty of a misdemeanor, except that any person convicted of violating paragraph (2) of subsection (a) of Code Section 3-3-23 shall, upon the first conviction, be guilty of a misdemeanor and shall be punished by not more than six monthś imprisonment or a fine of not more than $300.00, or both and except that any person convicted of violating paragraph (4) of subsection (a) of Code Section 3-3-23 shall, upon the first conviction, be guilty of a misdemeanor of a high and aggravated nature.
(2) Any person convicted of violating any prohibition contained in subsection (a) of Code Section 3-3-23 shall, upon the second or subsequent conviction, be guilty of a misdemeanor of a high and aggravated nature, except that any person convicted of violating paragraph (2) of subsection (a) of Code Section 3-3-23 shall, upon the second or subsequent conviction, be guilty of a misdemeanor.

But if he takes them to court, has no video evidence of what happened. They have proof of him with the 21+ band, then he just shot himself in the foot, and its going to get real bad real fast!
My vote is to not risk it, and chalk it up as a hard lesson!

If I remember OP got beater outside the club when he was handcuffed and against a trash can, doubt they'll have a cam there, but never hurts checking. If on can then he has a case. Opera already has bad rep about their bouncers, and business they do. They have been good to me, but i am still careful not to start anything there.

i'm not reading this entire thread but i would most certainly report it - its a suit between you vs club so i wouldn't worry about state coming after you for buying alcohol, etc... i would assume they are at fault for serving a minor then any damages you suffered by bouncers.

Well, I was at this club the other night, Yes Im underage. Im the bathroom this bouncer said he would sell me a 21+ band and 3 VIP bands, so i did.
BAM Just comitted a crime right there, by purchasing the band! All credability lost!

1) clubs hire off-duty cops bc they shoulf KNOW the law. Knowing the law means that...
--> they should know that beating a handcuffed customer in the face while he's choking on a dumpster shouldn't happen
--> that they are job is to remove them from the premises ... not interrogate or torture them out back
--> the club should hold regular meetings on what is allowed and what is not for their security staff
** on a 2nd note, unless you are going to jail or having sex I think it's illegal for a bouncer to handcuff you - but I will check on that.

If there where no cameras its a cop's word against his. His being the one who obtained alcohol illegally. 2. Sue if you want, no one forced you to drink. The bouncer selling the illegal bands actually relieves the club of responsibility. He was not acting in accordance with his duties, therefore, not under the purview of the club. They MIGHT settle for enough to pay a decent lawyer though just to keep their name out of the papers.
3. It is not unlawful imprisonment if their duties include detaining suspects until police arrive, which is what most clubs do with underage drinkers. They do this to avoid the drunk driving incident that was brought up.
4. It is complete BS that a business could be sued because of the incompetence of the people that go there. Should I be able to sue my employer if I get hurt in a wreck on the way home? How about Kroger if I am on my way from grocery shopping? Your safety is your own responsibility. It is not the job of a business to babysit its customers.

Comparing a walmart employee to a bouncer at a club is a huge difference. There are a lot of diff scenario's that could play out here.
Opera could never want this to go to court, they wouldn't want their name in the paper saying that one of their bouncers got caught contributing to minors and for assault against the same minor.
Opera could say take it to court, say that the kid was, while intoxicated, being disruptive and causing a problem. After being handcuffed he was struggling and KICKING at the cops, and that was the cause for your eye, was defense. It may not swing but I know in KY that if you kick at a cop and he slams your head into a hood, good luck pressing any charges. Its them vs an underage drinking.
He could take them to court, they try the above, and fail, and he gets money, fined for underage drinking, the bouncer gets fired in all scenarios, and he gets money.

I thought I was right that your license got suspended in GA for underage possession.
Also your right. Now that I think about it, a few years ago, last time I ever went to a club. Was wild bills, a friend of ours was there underage and got caught drinking from his brothers drink. A bouncer twice his size walked up behind him, pushed him, put him into a head lock and drug him out the exit where 3 cops where waiting.

Kinda reminds me of when I was in college.. we'd get some kegs and leak it to the high-school kids (underage) on purpose. $10 to party. Then we'd get a good count at the door while keeping a GOOD lock on the booze. We'd call the cops on our own party -- as soon as the cops get there the underage kids would BOLT! And we'd say we called the cops to get rid of them b/c they were not invited.
We kept the booze AND the money from the door from those fuckers (it was NOTHING to get 100 high school kids or more to pay every month) - LOL. Next month, we'd do the same thing - LOL.
Bouncer gets the money from you (and who knows how many others) then gets to throw you out on your fucking head and dot your eye for good measure. You get nothing in return - only if they would punch me in the face while handcuffed they'd be more famous than they wanted to be I can bet you that - underage or not. LOL

Had something similar happen at Opera. Their bouncers are power tripping low life's who will pounce on any opportunity to fuck someone up. Like Frog said, the system between the club/bouncers/cops is corrupt.
I think whatever chance you had was to press charges immediately following the incident, the cop(s) knew this and that is why they gave you the ultimatum. Wherever this goes, I wish you the best of luck.

As far as I know....the cops never took his BAC, correct? So therefor, OP can claim that he never took a sip of alcohol. He had just bought the alcohol and was just chillin when the girl took a sip.

This would be hard to prove that a bouncer sold you the bands in court. It could be argued that you found someone leaving and bought there bands from them. In which you knew you were in the wrong.
Im up in VIP and one of the girls im with takes a sip of my drink then they come and tell both of us we have to leave.
Staff member see you contributing to the delinquency of a minor and confronts you.
on the way to the stairs from VIP I said "I understand your on a powertrip" then the motherfucker pushes me down the stairs.
You start to get belligerent with a staff member and staff member knows you have been drinking and may become violent.
We get to the bottom and im looking around for him and he pushes me in my face (pussy), does it one more time and then I get swooped up by this big ass dude, thrown out this door onto a dumpster with my neck on the edge.
Staff member takes this as a I am about to get swung on and stops the threat. He does what ever he can to get you out of the club so you do not become a threat to other party goers.
Im now handcuffed by the bouncer and i cant breathe with my neck on the edge. So i say "I cant breathe homie" and he punches me in my face 3 times.
After getting thrown out you still try to charge the staff member so he does what he can to stop the threat once more.
HAHA, so now I have a black eye and some other various things. Cops talk to me and say if im pressing charges they are gonna take me to jail, and if im not they will let me go home, so I went home.
Lets see underage drinking, Public intox, and contributing to the delinquency of a minor are just three charges I see here. I am not a lawyer nor a officer of the law so I am not sure what all charges you could have been charged with. I am not trying to argue but I would let it slide. This is just how I see it.
Were your photos taken at the bar or once you got home? If when you got home I doubt they will hold any value. Anything could have happened to you once you left the club.
This is just what I can get from the story.

It sucks that you were sold an 21+ band to later get kicked out and beat up. I think you've waited just a little to long to make anything out of it. With that being said why dont you and a group of your friends go back with some hidden cameras and try to catch the bouncers selling 21+ bands in the bathroom and buy one. Then go out to the bar and ask for a club soda with lime and drink half of it. All you have to do now is take a swig of mouthwash and act tipsy, not drunk. For even more of an effect you could brag loudly how you are'nt 21 and you just bought the bracelet in the bathroom from a bouncer. This will more than likely cause the bouncers to treat you the same way that they did before, as they have an notoriously bad reputation. Then contact all of the local news stations. Im not telling you to do this but, it would be awesome and karma is a bitch.
