Anyone have any barrow county sheriff friends? I just got pulled over on 316...fucking 94 in a 65 sum bitch haha....he clocked me from the back...I came over a hill and he was going the same way. Regardless I think I am going to plead nolo on this one. I got a 16.5 over in december by a barrow county sheriff on 316 as well.

anyone got advice or anything. I believe you are allowed 15 points. 16 over will be 2 points and 29 over will be 4. I am 22 years old

lol nah i didnt realize i was going 94...i was told by another barrow county as long as i stay under 80 im good. i thought i was under 80. in fact im sure i was spedometer wise. I have big ass tires on my car so that may account for 4-5 mph but anyway...it was pretty stupid of me.

I am just wondering what the law is on this...being over 21 how many points are you allowed in a year.

GA DDS: The Department is authorized to suspend your license if its records or other evidence shows that you have accumulated 15 points within 24 months under the point system, including violations committed out of state.

15 mph but less than 19 mph 2 points
19 mph but less than 24 mph 3 points
24 mph but less than 34 mph 4 points
34 mph or more 6 points

oh if you go and get a dyno to show your speedometer is off they should drop the ticket down.

I am just wondering what the law is on this...being over 21 how many points are you allowed in a year.

i dont think it matters how many points are allowed a year. points will keep on adding up until you have 15 points and then your license will be suspended for 6 months. something like that

ALVIN
02-03-2009, 04:40 PM
thats what i wanted to know...so i only will have 6 points

I drive 316 everyday. Barrow county has been out with a vengence on 316 & Hwy 11 lately. You may be able to get them to drop some points, but Barrow ain't gonna budge on that fine, Nolo or not.

You collect points on your license, 15 is the limit, and it's not on a yearly thing. The points expire 36 months or so after you get them, so those 6 points on your license will be there for the next 3 years. If you get another 4 point ticket a year from now, for two years after that you will have 10 points and then the 6 will expire and you will have 4 points on there for a year. Does that make sense?

Oh, and if your speedo is off as a result of your wheels/tires being too big, and you can't get a shop to take blame for accidentally changing your rolling radius, i don't think you'll be able to use that defense. Even if you did, they would probably change it to a fixit ticket and you'd have to recalibrate the speedo or loose the wheels to get the ticket gone.

ALVIN

Im pleading nolo regardless not using any excuses. lol Thanks for the info though man

Vayda

Considering nolo won't get you out of the fine or any mandatory punishment, I'm not sure i'd do it in this case. You only get 1 every 5 years and it's silly to use yours now when you're not close to losing your license over points.

I mean, look at the consequences: Plead nolo, pay the fine and take any mandatory punishment, get no points. Lose your nolo for the next five years. In the meantime you might get a lot more tickets and then something stupid will happen and you'll not have a nolo as an out.

Or plead guilty, pay the fine, take the punishment, and get the points. Down the line if you, say, get into a wreck and get ticketed for it because the cop was an ass and it wasn't your fault, you've still got your nolo to at least keep your license.

Why not just plead guilty, save your nolo for something big?

ALVIN
02-04-2009, 10:58 AM
hmm Good point. I'm more worried about what the mandatory punishment is for 29 over. I have no problem paying the fine

Vayda
02-04-2009, 11:05 AM
I don't think there is one for that. Mandatory punishments are usually mandated by the state and the courts can't waive them even if they want to. It's stuff like the mandatory loss of license for a no insurance ticket and the mandatory loss of license for racing on the second offense. I wouldn't worry too much about it. If every driver with a 29 over ticket lost their license there would be much fewer drivers on the road.

I don't know much about barrow county but in marietta city and cobb county you can go sit in on the court some day before your actual court date and listen while they read off mandatory punishments. They give out a sheet that explains it in marietta too.

i got pulled over when i was 17 doing 28 over in a school zone and they told me that i needed to take the defensive driving class and after i did all that shit then it worked out. you can take that class to reduce the points you have now and it should actually remove all the points you have. they told me i would lose my license till i was 21 but cuz of that class i didn't. i kept my license and paid the outrageous fine and i had community service.

does that help?

but for sure take the defensive driving class.

it's $75 and it's worth it.

the only other thing i can tell you is to get a lawyer, which i'm pretty sure you wouldn't even need in this situation. i had one cuz it was a school zone
