hey all, my friend just called me saying he got a speeding ticket and wanted a little advice...its his first speeding ticket , first offense

county = gwinnett

"110+" in a 65...45 over? he was going 120

what do you guys think? i told him he might get driving school and some community service

thats what my cuz thought about going 80 in a 55 in gwinnett and he is 16. the judge moved his case to oglethorpe county for the sentencing phase but she recommended suspended license. and a 100 something fee just for the court fee. not including the actual find.

When i was 18, i got 31 over. The judge droped the ticket, i had to take one day school class and no points. This was in dekalb, when you walk in, the judge will ask if there is anyone here under 21. You being under 21, she might give you a chance like she gave me, but still ur shit is way more than 31 over buddy.

If he is super lucky, maybe the judge might drop it. Chances of that happening is very very slim. Seriously, your pretty screwed. Plead NOLO....Bout the only other thing you can do. My luck, I would have went to jail, car impounded, big fine, and everything else that they could throw at me.

You're likely to lose your license. A lot of times now they're actually more harsh with the first offense...especially when your not-too-sharp friend is hauling balls like that.

Not saying I haven't done it too....just don't get caught. lol Good luck in any case.

Are u sure bout that one:thinking: I was pulled over twice in GA for a 101 in a 55 and a 100 in a 45. I never had a suspended license because of that. Unless I answer my own question by telling u guys I was not a GA resident. But I was simply sent to that class (in DeKalb county.) With only a small fine in comparison to what I would of paid.

lol i got a 97 in a 70 when i lived in sc and nothing happened to my license, hell as a matter or fact i got it reduced to less than 10 under and 75 bucks. i think ga is one of the strictest states when it comes to speeding. i never heard half the shit about fines and punishments about speeding until i cam here.

a good friend of mine got caught for 105 in a 65 on his bike and was given a ticket for reckless driving, arrested, bike impounded. He went to court a month or so later and got 96 hours in county spread out over 2 weekends (had to report at 7pm friday night and was released at 7pm sunday night), almost 1k in fines, and license suspended until he was 21. He was also 19, but his ticket was from fulton county.

He has to take a defensive driving class BEFORE his court date, that way he will not have any points put on his record, and unless the judge suspends his license in court the DMV will not suspend his license if no points are put on the record. Plus he will get a 20% reduction in his fine. Remember the Defensive Driving class must be done BEFORE the court date. Its the only way, because the way the system works is that anyone under 21 who receives 4+ points for a single citation on will have their license suspended for 6months. Hope that helps.

If your friend wishes to beat it, he has 2 things to do.
1) Take a defense driving course before court date. This does not guarantee that the judge will be any more lienient, but it cannot hurt. If nothing else, it will take 7 pts off his record.
2) Get a lawyer IF he wishes to keep his license. A jugde does not have to accept a NOLO plea. If he does not accept your friend's plea, then it will be his word against the cop's. Think about this, the judge works with the cop and the solicitor every day. Who do you think that he will side with? A lawyer is his best option.

I don't get why people ask for "advice" on speeding tickets and other citations on here anyway. No one will get the same treatment for the citation. You can post up what the law says or what happened to you or a friend of yours, but it is whatever modd the judge is in and where you're at and all other things considered in the decision. my friend was busted going about 125 in a 65.

had a good lawyer and still came out with $1000 in fees but only lost license for 6 months. No jail time or car impounded. That was with a lawyer, sucks if you don't have one

His License are gone. Im suprised no one else said this in the thread, but YOU CANNOT use NOLO when you under 21 and you are going 24MPH+ over. Nolo doesn't work there. Trust me, I know. Your license is gone. Dont even bother talking to a solisitor, they arent gonna drop it 40MPH so you keep your license. Your license will be gone longer than 6 months I can assure you.

sleeper is right, i was gonna plead nolo but they said i had to be 18 i think(the guy wasnt even sure) and well yea i couldnt drive for 6 months after that.

If you get reckless driving then the judge will just fuck you anyways. Cuz they are gonna assume the worst. like weaving between minivans full of kids on a soccer-mom only highway.

Yall are missing the point, he was going 65 MILES OVER THE SPEED LIMIT. Your "supposed" to lose your license after 24 if you are under 21. He is almost triple that. unless they just changed the rules thats not true, cuz i used NOLO when i was 19 for doing 80 in a 55. that was 2 years ago. i got off with paying $90 and attending a class about speeding and drinking while driving. it wasn't a defensive drivin class though, it's something dekalb county schools does and thats where the $90 goes to aswell.

I think this could go either way.
I've gotten a 82 in a 55 which is 24 over and all i had to do was take a class in dekalb..the class was funny, there was this asian teacher that kept bad mouthing cops and their education level lol.

Your lisscence is lost, don't even doubt that. The only thing you need to worry about now is if you go to jail or not, which i doubt you will since you didn't get your car towed or anything that day.
Your best bet now is to cry and bawl so that you can lower the length of time you'll be without one...and to get a lawyer, just incase the judge is in a bad mood and decides to lock u up..they like to screw with teens.

but i have two lawyers working on my cases and in a situation like that, it wont be much. really it wont. youll maybe get off a little community service or less probation. but the suspension will stay the same.

I got 99 in a 45 a few months ago, and had to go to court for it, so it was 54 over the limit. I got a lawyer, and paid $1000 fine, and got 6pts on my license. Of course, I'm over 21, so it's a different story all together, but he better not go in there without a lawyer.

I got a 24 over and 25 over dropped COMPLETELY about a month ago. I didnt have a lawyer or anything. I took a defensive driving course before I went to court to show that I "cared" in a sense about my license. But that was in Johns Creek in Alpharetta and that whole courtsystem is bogus. I got 16 hours community service and had to write an essay. But I promise you that buddy who was goiung 65 over is losing his license

I never said you cant use NOLO when you under 18, But NOLO will NOT work for a 24 over ticket, If your under 21. I know that for a fact, it may even be the same if your older than 21, but he WILL NOT be able to plea NOLO, Im positive

Yeah, I forgot to mention the fines he will carry with that ticket. I can see it EASILY going over $1,000. I was in traffic court the other day, and this guy got a speeding ticket and his fine was $700. I dont remember how many over her was, but it wasnt a 65MPH ticket.

Yes it will, it worked for me. The judge even asked me if I want to use NOLO, my ticket was 31 over.

I guess it depends on when it was. I went a month ago, both tickets were different counties, and both courts said I could no plea nolo on my ticket. I guess its changed from when you went! Because I wouldve used it!

again, I have no idea how gwinett county works. But regardless of the speed it seems, u can take that driving class and get away with it per say, at his age. I did it twice at 100 and 101 and had no points incurred

I don't know what timeframe this was in, but the Department of Driver Services assess points based on a guilty/conviction for a number of moving violations, regardless of associated punishment from the court system. This means that mandatory driver safety school, DUI school, and other things, only lower or change points by a pleabargain system that changes your results from guilty/convicted to Nolo or you end up with a lesser charge. There is every possibility that the Judge could say "No fine, no community service, but you are guilty." and it goes on his record and DDS assesses points as normal. The court doesn't control your DL any more, DDS does all of that.

Again. Gwinett County is still part of the state of Georgia. They follow all the same rules as what I stated above. You're lucky for what you got, but giving that kind of advice could be very dangerous, since he may not be so lucky. I also pointed out that I didn't know the timeframe we were talking about. The switch to DDS controlling all of this and judges and police not being able to simply take your license on the spot is recent and has caused plenty of problems.

i went 15 over in gwinett as my first and only ticket I pleaded nolo... I still got how many ever points on my license. All nolo did for me was lower my payment from almost 200 to 28 dollars. I'd say just get a good lawyer

and to kill everyones joy now..i get my license reinstated in 16 days..boy that 6 month FLEW

anyway the story is:
i was rushing home one night after a long days work...
it was around 11 and pitch dark on 316...i used to be pretty stupid(more than i am now) and used to try to get home as quick as possible..so one night i was driving at around 75-80...and this set of head lights were reallly glued to my ass...so i was like, "ok buddy you wanna go?"

i started switching lanes to get ahead of the light traffic i was in and the "head lights" did the same... so i was guessing its someone who wanted to challenge my slow car..so i got in front of the last car infront..and punched it...
i remember going past 117 mph and checking to see where he was...indeed he was somewhat left behind...
suddenly..the car hits the strobes and i knew i was busted...

i dont speed like that anymore..i think ive learned my lesson...i paid close to $500 in fines and this will include $210 reinstatement fee i have to pay on the 19th..

so yea..continue flaming if you want...

I got one last year for 99 in a 45, which is 54mph OVER, and the cop didn't take me to jail (although he did take it upon himself to let me know that he COULD if he wanted to). I got a lawyer, and they still gave me the maximum fine, which was 6pts, and $1000. I had to pay my lawyer $1000 too, so all in all, it was a very expensive mistake. No jail time though.

it was around 11 and pitch dark on 316...i used to be pretty stupid(more than i am now) and used to try to get home as quick as possible..so one night i was driving at around 75-80...and this set of head lights were reallly glued to my ass...so i was like, "ok buddy you wanna go?"

i started switching lanes to get ahead of the light traffic i was in and the "head lights" did the same... so i was guessing its someone who wanted to challenge my slow car..so i got in front of the last car infront..and punched it...
i remember going past 117 mph and checking to see where he was...indeed he was somewhat left behind...
suddenly..the car hits the strobes and i knew i was busted...

i dont speed like that anymore..i think ive learned my lesson...i paid close to $500 in fines and this will include $210 reinstatement fee i have to pay on the 19th..

so yea..continue flaming if you want...

And if you pull that shit again on public roads i hope you hit a tree and fuck yourself up and have to live all fucked up the rest of your pitiful life. Theres no excuse for going that fast. Its called move over and let the person pass, not play fast and furious. Alot of people die on public roads from idiots like you each year leaving their families torn. I hope you learn something from this and grow the fuck up and quick. If i were the cop i would have beaten your ass black and blue and locked you up and said it happend while you were in the jail. thanks man..yea im sure we've all done some speeding and racing on the highway..i mean after all this is a car website and i bet alot of guys on here like to speed and race... and im sure theres also some guys on here that would rather not push their cars and are all about the show...and the 50 or so guys that were hatin and cussing me out...im sure they allll drive at the speed limit and speeding is something completely alien.
anyway i think deathrex prolly had a horrible day and needed to cuss someone out to vent...its str8 i understand, deathrex..im just glad youre not a cop cuz you would probably abuse your position...and i hope he doesnt have kids...they will be black and blue all the time!!

the cop was pretty cool
he comes to the passenger side. asked me why i was going to fast. i told him. he went to his car. 5 minute later. 2 more cop cars pull up. i was like ok im going to jail

but all i saw was the other cops pointing at the ticket, then the highway..talk to my cop for a bit..then they dipped..i said sorry...went home and got bitched @ by dad.
i think everyone one of my close friends have dealt with somethin like this
benefit had lost his license for a year or somethin.
chevy350's license is currently suspended for doing 70 in 35(more dangerous)
one of my other friend tried to drift in his 240, lost control and hit a parked car. no trouble for him
we're not dumbases.we all decided to learn the hard way..

i want to see someone on here that never fucked up, yell at me..i would then understand their excuse
