Late sat night i was in the mx-6 going to a buddies house who was the passenger and i was following his brother in a ford explorer. We were at a redlight and out of nowhere a pickup truck comes and nails the back end of my car...it's pretty much totaled and i'm sitting here with a sore ass neck. They driver of the truck was drunk and arrested and sent off to jail.

what should i do about the situation? law suit? let me know if you guys know any lawyers that handle cases like these.

Insurance should take care of the damages to your car; however, I don't think you can file for medical reimbursement if you didn't go to the hospital from the scene of the accident. Not 100% sure though.

If you didnt goto the hospital you are pretty much screwed as far as the medical goes. As for the car, you should be able to "sue" for a replacement even if it more than the car was "worth".

i went to the hospital because my neck is sore as shit...the gave me some prescripitons luckily i didn't have any broken bones.

I had a similar experience this summer. I was rear-ended by an 89 year old lady who shouldnt have been driving in the first place. A few days after the accident I went to an orthopedist. The orthopedist told me to do physical therapy for a few weeks. So I did, my neck felt great by the end and it was all paid for by the insurance company. A few months later the insurance company gave me a call and offered me $750 for pain and suffering. So it all turned out okay, except for my car.

i was in an accident with a friend last year (on my bday :() he was driving and I was passenger, then some idiot decided to turned at red light so we hit them. Nothing really happen to us except for his car and i had a concussion + scratch on my head... went to hospital the same night and both insurance (my friends + the person who turned) offered me $8000 + $7500, so is a win win for me.

Just keep telling them your neck hurts everytime you talk to them. Don't take a penny less than 4 grand...lol
