got t-boned on my bike yesterday

I want to know what I can do legally to get my bike and medical bills covered. The cop said it was my fault. I was on hwy 20 next to the qt by 85. i was turning left to go into my apartment complex and the other guy was turning right to go to the same place(with blinker and all). He didn't make the turn but instead switched lanes to go straight again and t boned me dead on. But i got the ticket for failure to yield before a turn. I did stop.

what can i do?

Yeah, a lawyer is your only bet seeing as how you were issued the ticket.

Thats going to be a hard one to fight. He has the right away your coming into his lane, usually in those situations they will give you a ticket for what happned. Failure to yeild, thats why alot of people wait to make sure they are turning or not even w/ there signal on. Sucks though man, that almost happened to me before also. Hope you get out of it, g/l. Next time wait just to make sure.

I was turning into my apartments last night and i was in the turning lane turning left. This guy is turning left out of the apartments. He doesnt yeild to me and jumps into the turning lane...where I was. I had to jump into the right hand lane to avoid being hit. I know how you feel with stupid drivers

Buddy of mine got hit on his huffy a year and half ago... Car was going 55 and he was estimated at 24 on his bike... Driver tried to turn down a road at the last minute and went to wide and hit him. He flew in the air into the ditch and woke up a few days later... He had to lay at home for 6 months before he could do anything. He is just getting to where he can walk around now.



To the OP, be careful. It is not always easy to see someone on a bike when they are in a car. Next time don't just assume he is going to turn. Make sure, even if he was to turn, he had the right away.

Dude,I didnt even say shit or post today. And my name already comes in here? LOL. But yeah my fucking huffy gets good ass MPG. I go around the city for like $1..(Drink cause i get tired)..LOL.....Fuck huffy's..I drive Pocket bikes and 250cc go karts. :taun: :lmfao:

They let him out of the hospital Saturday night with a lot of medicine to keep his blood pressure from sky rocketing.. He had to go to a heart specialists this morning and still waiting results... Hopefully everything comes back good.

Ive almost gotten hit turning into there quite a few times. People just dont pay attention.

Not only did he jump across solid white lines, but if he waited long enough he jumped across a median type area with all the lines striped through it. This same exact thing happened to my buddy (except in a car) in a different spot and he got ticketed also. Car was in the right turning lane to turn right, straight was not an option, and at the last second he jumped in the straight lane and t boned my buddy who was turning left, and my buddy got ticketed.

your at fault, the other driver is not committed to the turn until he has actually started the turn.

get a lawyer and and have a special accident invesigator review the case. i did that once.

Simple answer: Nothing - you are at fault, plain and simple.

That is why you make SURE that the person commits to the turn before you make a move. It doesn't matter if he has his blinker on or not; perhaps he hit it by accident, who knows. Perhaps he changed his mind and went straight. He DOES have the right to do so seeing that he didn't do anything illegal in the cop's eyes hence why he didn't get a ticket.

You will have to pay your deductible and your insurance will take care of you (depending on your coverage). There is really nothing you can do about it in all honesty. You failed to yield the right of way.

see i think that's bullshit.

i see people do this ALL the time... like i'll be driving behind someone, i can TELL they're lost because they slam on brakes at every single road... then they'll put their blinker on, get into the turning lane & slow down, then cut me off while darting back onto the road & almost hit me...

what happens in that scenario?? if you're following someone, they slow down & get into the turning lane, then you continue on and as you're passing them they come back over & hit you?? would that be your fault too? since they didnt COMMIT to the turn??

that's damn stupid. the dumbass should have looked where the hell s/he was going before s/he just DARTED back into traffic.

i would get a lawyer. s/he could have ran you over and killed you because of how oblivious they were being. i swear to god motorcycles are invisible to some drivers.

And I hope you win the fight but when maknig a left turn you must yield to all oncoming traffic, and it will be his word against yours. And unless there is a 3rd party witness to testify the other driver switched lanes illegally I think you'll get charged with the ticket/fines.

If only Cochran was alive....he could disprove gravity! goodluck!!!!

thats also why I'll never have a bike. It's the WAY too dangerous. CHASSIS/safety features FTW!
