View Full Version : Speeding ticket... fighting it?

hey guys
got a speeding ticket a few weeks back, didnt think too much of it until arfnsx mentioned it to me today.
i was caught doing 80 in a 55 on 285. i didnt think i was speeding because i was doing the flow of traffic, but thats no "excuse" i guess. but honestly who does 55 on 285... anyways at the same time i was nailed for not using my blinker, but i was too busy ****ting my pants when i saw a light up roof rack behind me.
however when i was caught, the cop was sitting on an on ramp, which is not level with the freeway. what im reading from researching on google is that in order for a radar/laser reading to be 100% accurate, the user has to be behind or in front of the car.
the cop that got me was on an incline. im still doing research to see if it actually throws the radar off, but does anybody know off the top of their head if this is a right claim?
if not ill just go pay the ticket and take it as a lesson learned, as it is my first ticket.

i think the only defense against something dealing with an incline is that police can't use radar/laser to check you if yo uare at a 7% incline or more.
But i already told you they'll drop it a little for you in court

go to court...
the judge will drop the speed to possoiably a non-moving violation and you'll have to pay the fine...
not much you can do about the incline thing it'll be your word against the cop's and who do you think they'll believe?

yeah i figured as much. i dont wanna argue against something anyways, cause i was speeding regardless if i was doing the flow of traffic or not. ill just suck it up and pay it -.-
you can find me these days in the right lane doing 60mph on cruise control :)

def go to court, especially since your 19, if you dont have it reduced, then you lose your license, but like i said take a defensive driving course before it tho, so that you look like your trying to better your situation.

what can i do to get it reduced? isnt it all up to the judge though?

it is up to the judge and they'll most likely reduce it either way

yea i was in the same boat as you, i was 17, and got an 80 in 55 on 85, but it was dekalb. but it all depends on the judge, the one i got didnt give me any fine, no points on my license, he just told me to take a defensive driving class, and be on driving probation for 120 days, so basically i just couldnt get a ticket. I got really lucky, but that was almost 5 years ago, plus my mom was there standing with me in front of the judge, so that probably helped a little bit. but i would take that class anyways, bc most likely youll have to take it regardless, but anything will help, so i suggest it.
off topic, but what size are the tips of your exhaust, bc i ordered something very similar, i love the way yours looks and mine looks like poop, so....

Take defensive driving.
Go to court.
Talk to solicitor.
Don't give excuses, just apologize, show you learned your lesson by taking defensive driving, etc.
Be nice and courteous.
More than likely they'll drop the speed amount to 14 mph or less, thus it won't be on your record. However, the fine amount might stay the same. But, you gotta pay to play.

for first offenses, he still has the 'nolo contendere' plea. no points or insurance premiums, just pay the fine i believe?
fyi, you dont have to be going 55 to not get busted. i used to drive 80 miles a day on 285 for 4 months, always cruising at 70-73, and not once pulled over. i used to see the cops ahread of time/ let them cruise by me in traffic and maintain 70 while everybody else goes to 55 and never get stopped. but 70 is actually faster than most drive on the freeway anyways. the flow of traffic does not do 80.

Yeah, Dekalb is cool about it.. You'll be fine..
Lawrenceville is a diffrent story.. I had a 15 mph ticket and they wouldn't lower it 1 mph in order to not go on my record.. I was in court and asked the prosecutor who then looked at me like im crazy and said with an attitude: "If I lower your ticket, I will have to lower everyone's ticket"

If it were to be reduced, it would be reduced to either: a non-moving citation (highly doubtful), or a reduced speed.

well his in cobb, that is why i was stating that i got one in dekalb, ive never been to cobb court(knock on wood) so i dont know how the judges are. but like ksniperfox said, you can always go nolo, so think about that as well.

You can still get points with a no lo plea...
With that said, was it local or State Patrol?
Also, the 7% applies to YOU, not to the cop. Also, they can be in front, side, behind, etc, and still get an accurate reading.

what did they catch you with? laser or radar?

Yes and no. It might get your fine reduced, but it will still probably show up on your insurance.
The reason that I asked about the cop is because local cops have to abide by the 10mph, 7%, visibilty rule, etc while State Patrol does not.

no need to be mean, asshat. i clearly posted a question mark, and "i believe". please, correct me if im wrong, but keep your **** to yourself. merely tryin to help this guy out here. i only speak from experience, i used it on one of my worst tickets, and it saved my license and my insurance went up $0. coincidence? you make it seem like there is no advantage to pleading no contest.
if he doesnt plead that way or fight it, his license will be suspended. on the contrary, my advice is great. compared to losing his license. so eat it.

:eek:WTF?!?!?!?!?! I got an 84 in a 55, went to court dropped from 29 over to 19 over, with added court fees paid $273 out the door. I feel sorry for you bro!

take defensive driving to be on the safe side. gimme a call i can hook you up with a place that will just give you the certificate and you won't have to sit for the bull****.
if you have that in hand, you will get it dropped to non-point violation in court for sure (95%)
