I dont know about video.. possibly hes was about 8 cars back and i dont think he was there the whole time ... he turned on his lights like 2 minutes after the last pull. ( very short pulls the first one was a 4th gear from 3.5k-6k and the second was 3rd gear. 4k-6.8k ) no speeding idk

well see this will be my second ticket. one for swerving out of the way of a retard slamming on his breaks when seeing a cop, and the cop pulled me over because i have a loud subaru with gold wheels.. that was "25mph" over and i had to take a 12 hour DD that cost me $200, and then a $75 fine on top of that.. i think i got like 4 pts for that. but im 18 now and you can have up to 16 pts every 2 years. he said this ones 6 so i'd have 12 pts total not enough to loose my licence. my friend in the IS300 on the other hand is ****ED!!! he already has a 28 over in a construction zone and hes 17.

UGH THE IS300 OWNER KILLED any chances of you beating this ticket when he made that comment to the cop.

Also you do not have to be speeding in order to get hit with a racing ticket.

Get a lawyer that has pull with the local traffic court judge or prosecutor that will be hearing or trying your case

Yeah I would definately get a lawyer and dispute it. I got a racing ticket 3 years ago which was 100% bs cuz at that time I was driving a 100% bone stock 1999 Toyota Camry and I never broke speed limit nor did anything to make someone believe I was. Never the less I got a racing ticket and that female cop took me to jail(I was 17 wtf a minor), and when my court date came my lawyer got the racing charge dropped...as well as my possession of less than 1oz of marijuana charge dropped!!!!!!

You and your dummy friend could've pleaded the 5th. You have the right to remain silent. Anything you say can and will be used against you in the court of law.
But you incriminated yourself so if he wrote the statement down, you are screwed. Congradulations.

As far as the ticket goes, I'd take that shiit to court. He probably wont show, then the ticket will be dropped.

**EDIT: I just read the rest of the thread, and you my friend are fuked. You & your retarded friend admitted guilt to the cop and his word WILL stand in court. Ever heard that oldies song "I faught the law and the law won"? Thats whats gonna happen. I'd still get a lawyer though.

automatic licence suspension if your under 21, you might be able to get it dropped down to reckless driving. If your lucky.. that will still however be a licence suspension, but have less points/fine. Good luck, maybe you get a really good lawyer who can do better.

LESSON 1: When a cop asks you, "do you know why I pulled you over"? Tell him NO. Whatever reason you say, you admit guilt to, wether its speeding, running a redlight, poundin your pud, whatever, if you admit guilt, you are guilty.

Said he wasn't over speed limit in 4th gear at 6k rpm too... That better be a very high speed limit...

Anyways, you might as well give up on trying to get out of it. You are not allowed 16 points every two years. You are under 21, you don't have that priviledge(sp?) yet. I believe it is 6 points under 21 and they pull your license. Not sure exactly though

I'll be honest with you: Georgia State Law says that if you pick up 4 points or a reckless driving offense at once, you lose your liscense if you're under 21. Regardless of total number of points. It's an administrative suspension for picking up that big of a ticket, and comes as part of it, rather than a revokation from the DMV for exceeding the points limit.

Feel free to fight the ticket, but if you're driving a Subaru that's "Loud" and has "Gold Wheels" and your friend's in an IS and is 17...I hope the Judge takes both your cars away and gives them to worthy guys who can barely afford to put the gas in their DD's now. :|

Especially doing pulls in Alpharetta on 400.

And yes, I am just bitter and jealous.

Barefoot

if your under 21 your license is gone no questions asked. the fine can range depending on a lot of issues the main 1 being how pissed of the judge is that day. i had 1 when i was 20 days from my 21st. the judge took my license for 6 months. i had to pay like $500 in fines take a dui/dd class $75 to get it back then pay the reinstatment fee $1xx.

video, yes. Audio....more than likely not.

Often dash cams are connected to a wireless mic on the officer so there could be audio - but 12 states do not allow audio recording.

GA allows it. depends on if the county had enough money to afford it. courts are officer biased anyways.

I'm not sure I agree with this in most cases. More often than not you aren't going to be able to talk you're way out of a ticket through denial. If you know you were speeding, fess up to it. More people get away with warnings when being straight forward and courteous with the cop than acting totally oblivious. The exception to this is if you honestly don't know what the cop pulled you over for. I wouldn't reccomend guessing :)

I wasnt aware of that. I went on a ride along with my cousin about a month ago who is a Lawrenceville cop and he was telling me that his dash mounted camera comes on when his lights come on. I thought that was pretty nifty.

well, speeding is a different story. I got out of a speeding ticket just by being cool with the cop and telling him I was running late to a UGA game. You are right about not being able to get out of a ticket using denial, but I would never admit to racing.

IF U DON'T GET CLOCKED OR THERE ISN'T ANY VIDEO PROVING ANYTHING U CAN'T GET INTO TROUBLE BUT WHEN U ADMIT IT U SOLD YOURSELF UP THE RIVER

Actually, you don't need to get clocked or get a video. The officer can say you were going "Too fast for Conditions" which he can testify to in court by describing your behavior and the conditions. Doing the speedlimit and making lane changes through traffic might not be strictly illegal, but if the traffic is doing 30 and you're churning through at 65 by hopping lanes every other car, he can easily give you a ticket, even if every single lane change was perfectly safe, had plenty of room, and you used your blinker. Traffic laws are funny things, in that they work on the assumption of guilt rather than the assumption of innocence. The Officer's testimony is proof enough in MANY cases. The appeals courts have repeatedly decided that because there's a limited amount of money (Under $1,000) and no jail time involved in traffic violations, your due process rights are similarly limited. This is also why Death Penalty cases get more than one right to appeal. The severity of the punishment demands the strictness of the scrutiny.

if you're under 21 thats automatic suspension 6mo+. If you're over 21, you might have a chance of getting it suspended for 4 months + probation unless you have some money then you probably wont get the probation, but you'll still get your license suspended anyways.

My bf and his friends got caught racing a while back..the police was on the other side of the road.. but he said he saw us so we went along with it. My bf pleaded guilty and got 4 months suspension while his friends took it to state court and now both of them lost their license(s) and they both have community service and probation.

- If your car was really worth beating that is300.. then you really should've took it to the track. Now the both of you wont be able to drive that 'fast car' anymore.

Ok, here's some advice i'll tell you from real-life past experiences i've had and comparing it to yours...

If charged:
*Racing ticket = 6pts, automatic license suspension no matter what age you are
----The ticket should be around $500.00
*Speeding fines = 6pts
---anything over 100mph = $500 and something dollars
*Reckless Driving = 4pts
---$1000

Note: This above was all charged from Braselton.

My advice,
You should've never admitted to anything and kept quiet like I did in my past experience. Act polite no matter what and try to keep talking back to the officer only when necessary. Don't street race anymore; keep it @ the dragway. Eventually every street racer will get pulled over at one point in time...no matter how smart you think you are.

*Get a lawyer; I only paid $750 for mines because my lawyer didn't have any experience doing my kind of case; he was all *DUI* only, he had thought it was a piece of CAKE. :D When you get one, don't lie to him/her, it'll just make it worser if you tried. Not that I lied but some lawyers will try and be aggressive and make you spill the beans before hiring him/her. You'll need at least a week ahead of your court date for your lawyer to work out your case for you. Lawyers can take a lump sum of their payment from you at the 1st appointment and take the rest of your payment a few weeks later; that's the best they can do. I've had one asking for $3500; I said HELL NO! $1500 is a reasonable price my friend... You can start by searching Georgia Traffic Lawyers or if you have the money; go to Prepaid legal services, they have a very large office and alot of people & experiences. In the end, the lawyer will have a negotiation to reduce your speed or get rid of racing; it's all in the hands of how good your lawyer is...

*Go complete the Defensive driving course online; it's about $34 before shipping your certificate. Very convenient and helpful for you. And do some community service as much as you can before your court date to show the judge that you were sorry for what you did. Go with Redcross/Atlanta chapter or whatever community you would like to serve.

*You'll have a choice of relocating your case to a different jurisdiction of your choice if you are not satisfied with your case results in your current jurisdiction. But there is a 50/50 risk the next jurisdiction will not guarantee a better result or even worser. If you can drop *racing*; just get it over with my friend. You will have to plea guilty and pray the judge agrees with you/your lawyers negotiation. All you have to say in front of the judge is No, your honor & yes, your honor. Nothing else unless you have questions for him/her.

*Also get a copy of your driving record from your local DMV for about $8 for your past 7yrs of driving. The lawyer will need all your info on the 1st meet.

My conclusion from helping you out;
I was treated far worser when I used to have a thread up but in the end all the people that really gave me advice boosted my confidence up and I was fine in the end. I give you props for posting up and we all learn our lessons at some point. I'm not just helping you out here but this post will give other(s) out there factual advice and opinions on what to expect when it's their turn to face the consequences in the future. Hope I helped you out alot there my friend.

P.S Now, where's my REPS PEOPLE!! :goodjob:

I'd definately get a lawyer because ive been in a similar boat before. I would say you wouold get off with it if you or that other guy hadnt said anything about "winning". A cops camera usually only records (onto their little databank thing) after their flashing lights are turned on (thats what numerous lawyers have told me) but he has all of the audio when talking to you no doubt.

GOOD LUCK IF YOU TAKE THIS GUY'S ADVICE.

Keep your mouth shut and let your lawyer do the talking. Find a traffic lawyer that has dealt with cases like yours in the past and knows the courts (the county you will be tried in).

Wow. You really expect to post a thread on this site and not get a bunch of smartass and spiteful comments thrown in with the useful stuff?

It would be in your best interest to get a lawyer, based on what you've told us occurred.

Let us know what happens with your court date. It would be too sad to not hear updates on how you lost your license.

Good luck.

Hey man, I know how it feels to be treated more or less. Just trying to help the people who ask..hope ya read my post. Good luck & F** all the haters! Their time will come.

P.S. TRUST ME! Your gonna need a lawyer for this one. It don't matter if you weren't incredibly speeding...Once your charged with racing; that's automatic license suspension for a year and skyrocketing insurance rates for you for a long time. I know you can't afford to lose your license; who can? Carpooling sucks, not driving sucks enough, not being able to get a workers permit will suck even more. I'd rather pay the lawyers fee and be safe then sorry. Ask all the lawyers around to see what they can do for you best! Don't rely on the court solicitors; their on the courts side, not yours. Good luck once again!

Nobody wants to fawk with the law; that's some serious shietttt!

The Fifth Amendment protects witnesses from being forced to incriminate themselves. To "plead the Fifth" is a refusal to answer a question because the response could form self incriminating evidence. Historically, the legal protection against self-incrimination is directly related to the question of torture for extracting information and confessions

Not only does you spelling prowess would make a blind man cringe, your math skills need some brushing up. You said half the people that commented..... That would be 50%. That would leave the other 50% left helpful comments. So how do you figure the 4%? What you should do is not worry so much about driving for a while. Just register back in school, 2nd grade should be a good starting point after seeing your posts, and concentrate on making yourself a smarter, better person. They even have these big, yellow school buses to take you back and forth so you won't have to worry about being "mistaken" for racing. Later, QD.

There wasn't any point of you asking for IA's opinion....if you're going to argue every comment made. That kind of defeats the purpose of an opinion.

Now, IMO either way it looks like you're going to pay out the a$$. So, you may want to take the defensive driving class beforehand. It probably will cost about $75. But you can show it to your insurance company and they may give you a discount (which your rates are about to go sky high after this because they will find out about your "racing"). Also, I wouldn't waste my money on a lawyer. That's money you should be saving towards your fines. Bite the bullet and if you really feel remorseful, prove it to the judge.

its a year suspension. Unless u can find a badass lawer. I got a speeding ticket for 28over(it was bs there was no way in hell i was going that fast) and couldn't get a lawer and lost my **** for 6 months. Had to pay 2xx ticket fine(after it was reduced wit my Defensive driving) and i gotta pay 210 to get my license reinstated. My 6 months was up on the 14th and i dont have the 210 to get my **** back..... it sucks. I really wanna cry...
But you can only get 4points if ur under 21. Take Defensive driving. Even if you lose your license ur fine will be reduced some.

Please don't post blatantly false information as advice to this kid. He needs to man up, tell his parents that he ****ed up, they obviously have money. Once he does that he can get a decent lawyer and try to keep his liscense. The Lawyer isn't going to fight based on a fifth amendment violation. We have the right not to incriminate ourselves, which he CLEARLY and OBVIOUSLY waived by replying to the question the officer asked. Admission of Guilt was OBVIOUS when the police officer presented the statement, and considering he was not detained but was stopped for a traffic violation observed by the officer, there is no neccessity to have read his Miranda rights prior to asking the question.

In the case of Miranda, Stops are usually an exception due to the nature of the situation. The Officer asked an open-ended question without requiring an answer of it. This is the same as a police officer walking up to you as you're coming out of a jewelry store with full bag of watches and asking you "Do you know why I'm stopping you today son?" and you replying "Oh yes sir, it's that Jewelry store I just robbed." At that point, the reason why he actually stopped you is only relevant in the sense of probable cause for having initiated the stop in the first place. Traffic violations have always been considered probable cause. In other words, the admission should stand in court because it was clearly voluntary AND obvious that it was an uncoerced admission of a crime.

Too bad you didn't pay with your life. Dumbass. Leave the "pull" shiit at the track. Later, QD.

Please tell me what type of car you drive, so if I ever see you wrapped around a tree, with half your head gone, I can just laugh and pass by. I mean, if one of your best friends died in a car crash tomorrow, you shouldn't worry. You can just replace them with a new one from the store, right? Maybe you could just press the rewind button, and tell them beforehand, if you cared about them that much. :2cents:

The best part is, if he supplied correct information on the first post, they were not even speeding. I can see what you mean by someone needing a serious "knock" in the brain if they were going 120mph down the highway in traffic, or even in an isolated setting, but they were not even speeding. Just horsing around(Legal Speed Limit). I could downshift and pull in my car two-hundred times next to you on a highway and you wouldn't even notice. It's just those damn exhausts and high RPMs(Boosted I-6... lol, I'm sure the exhaust is quiet, especially since a seventeen year old who doesn't know what it means to shift below redline drives it). Not a good mix. ;)

(All information I supplied is based on basically the first page of this thread, I can't read the second page because the school computer blocks it, and I'm too lazy to read the rest of the pages. So, if he restated and said he actually was speeding or something, after the first page, I didn't read it.)

Anyhow, maybe if the IS kid actually had an interior and a sunroof like a normal IS300, then the cop would of just cried, and left. :D

I always forget that people are smart enough to horse around in traffic. I know how amazing some people are at driving. I remember driving down to uhh.. somewhere south, south of Atlanta but still in Georgia, and I live about 45 minutes north of Atlanta + I went during a 75, 85 lane closing. :(
About five times on that trip, someone attempted to merge into my car, with two of those people actually looking up when I'm blowing my horn and they still keep merging into my front bumper. I love people who look into their rearview mirror to merge... :2up:

Actually I think if you are under 21 but over 18 you can accumilate 16 points(like a bunch of 2 and 3 pt offenses) in two years but if you get one ticket of 4 or more points (racing, wreckless driving, or speeding over 24mph over) your license is gone.
