It is not legal unless you two had a written agreement on the matter. Otherwise, she has no ground to hold your check.

i attempted to call several time the following day and was neverspoken to
-- do you have phone records showing that you called?
-- did you leave a voice message or verbal when you called? Who did you speak to (did you get their name)?
so now a few days later i go to pick up my last check and drop off the key
How many days is a "few days"?
when she finally does arrive she tells me that since i just left they had to have the locks changed and i owed her 500$ for the locks
-- did she provide you a receipt from the locksmith?
-- did she still insist on taking the old key back from you?
also that she is going to hold my paycheck untill i pay the money
No this does not appear to be legal. You can inquire w/ the Dept of Labor to make sure.

- GET that invoice, then call the company to verify that there was service done.
- also noteable that she never once tried to contact you to get the key.
- you quite possibly effed yourself by not leaving a message w/ anyone.
- I am leaning HEAVILY towards withholding of pay being illegal.

I can't comment on your knowledge of engines because I don't know anything about it myself, but all other areas of (whatever), I can pretty much comment on. And, as usual, you give pretty bad info. First off, he should left the key on initial walk-out. With someone in charge. I know he said he called the next day, but I wouldn't have waited several days afterward. I wouldn't have even called that following day. They have a business to protect. Since they didn't hear from him for several days and they have no record of his calls, they have no other recourse except to change the locks out. They don't know what he could do. If they aren't willing to work with you (and they probably won't only because they don't want to take the $500 hit), then you're out that last paycheck. Later, QD.

It's not in a lot of cases. I know of many companies that have this policy. A lot of times, these policies are in somewhere in the employees guidelines or paperwork. My last job, Budweiser, can do the same thing when you quit. If you don't return your uniforms, you will be charged the cost out of your final paycheck. Later, QD.

I didn't mention a contract. It's just part of the paperwork. Usually, it's one of those "small print" type of deals. Later, QD.

When she handed you the key, she should have ALSO handed you a "hand receipt". As it stands, she has NO proof that you even had a key. Nor did she give you intructions on what happens once you are no longer employed there (as far as the key goes). How many keys do they have - what list can she provide of people that have keys --- are these records accurate? Is there a "DO NOT COPY" stamp on the key? If no... ANY1 who has ever had a key there could get back in... I could go on.

I found this, which may be helpful to you.....or not:
An employer may refuse to pay final wages only if the employee owes the employer money due to gross negligence, willful misconduct or dishonesty. These often are difficult and expensive to prove.
You fall, unfortunately, in this category with not returning the key "in a timely manner" to the store. This could be any of the three. You have no proof of trying to get in contact with the store as you never actually went up there for a few days. Later, QD.

Georgia is an "at will" state meaning employers and employees have the legal right to quit or terminate "at will." I don't think her case holds water unless there was a contract specifically stating responsibilities and damages if something were to go awry.

If u go to ccourt, just argue that u left the key in the store when u walked out. And argue that you have bills to pay and that u gave part of your life to her stupid company, and for her to repay you like that, is un-human.

Oh yeah, and since when did changing locks cost an even 500 bones?
definitely sounds like BS to me...just threaten escalating it unless you get your check... Or somehow acquire your check(perhaps covertly w/ a friend who works there)... deposit it and let them never hear from you again lol... If they try to come at you, they can't prove they gave you a key to begin with, since you didn't sign for it lawl... Thats what i'd do.
