I posted some months ago about getting a call from some chick that did a model feature on our site. She lost a job supposably b/c of the riske' photos we have of her on our site. Well she got real smart with me on the phone and tried threatening me with lawsuit....

So today I get a call from her boyfriend... he begins to tell me "they've tried to get these photos taken down for years now" and "she was 19 when they were taken now she is 22 and wants them down... blah blah blah". Thenhe begins to tell me that "she had a lawsuit over this and they were supposed to be taken down already..." :thinking: I was like really b/c I don't know anything about any lawsuit. He then retracts and starts to threaten me well we will just take action over this.

So what do you guys think we should do w/ the feature/photos? Anyone know anything about internet/copyright laws?

even tho there was no written contract between the site and her, it was verbal. she agreed to do the photo's for this website which makes it your right to be able to post them. if she were to bring up sometype of lawsuit, i doubt it would go so far since there is clear proof that she did it for the website and as long as you had the photographer there as well as the owner, julio i doubt anything could actually happen

If she signed a release with the photographer, she's got no grounds for anything if the release is well written. Contact the photographer and see.

Technically, whoever the photographer is owns the pictures. Therefore, as the owner of the pictures, in a professional shoot like that, it comes right down to the photographer having the right to use the photos as he/she feels fit.

That said, this photoshoot was done FOR ImportAtlanta. She is 19, which means she is of legal age, and upon taking the photos, she understood that the pictures would be posted on an internet site for public use. By agreeing to the shoot under those speculations, ImportAtlanta has the right to use the photos as it wishes.

That holds ESPECIALLY true if IA actually paid for the photoshoot/photographer's time/etc. I dunno if you guys did, I know there's a lot of pro and semi-pro photographers on here who would do it for free.

Long story short, it is in no way IA's fault that her decision came around to bite her in the ass. She would have something if you guys posted them without her initial consent, but since she gave consent for the photographs to be used as an IA feature model shoot, IA is doing nothing wrong. The "nice" thing to do would be to take them down for her, but there is nothing in the law stipulating that you or IA would be forced to do so. She took the pics knowing they would be put up on a website as a feature model. That's exactly what is being done with them. It's a risk you take when you decide to climb into a pool wearing nothing but a white T shirt and have a website photographer take pics of you for a feature. At the time it probably seemed like a great idea. Tough cookies if it bites you in the ass later, princess.

If the pictures are no longer needed/accessible, why not just take them down. Granted, I think that they could have been a bit more "courteous" with their request. Threatening people when you are not in the right will get you nowhere fast.

At the end of the day, however, the admins get to make the call.

I don't think she was a scheduled "feature" though. Those pics were taken in multiple locations, at different times. So they may have just been pics that a photographer had in their library. If so, then she may not have known necessarily that it would end up on IA directly. Even with that said, if she signed a model release, she's SOL. :goodjob:

you might have a problem if there was no WRITTEN contractual agreement. i really hope IA does not conduct all of its business this way.

who took the pictures? were they for IA only? did she know they were to be posted on this site?

if someone representing IA took the pics and then posted them you should be able to handle the situation. if she had the pics taken by some other company and then sent them to IA, there may be a problem..... unless you have a hardcopy of an envelope or something she personally sent to IA.....


whether shes ugly as a dog or not doesnt change business laws....
