View Full Version : Legal Advice: "too fast for conditions"

what should i do? its long and maybe pointless.. don't read if you don't want to.. if you dont feel like reading the whole thing, read the Bold

ok, so i was driving on 316 and one of my biggest pet peeves are the ppl that stick on the left lane and dont keep right.. also when two cars drive along side each other, right at speed limit and wont move over.. ARGHH!! www.slowertraffickeepright.com

anyway, i was driving like a maniac and cutting people off and speeding excessively.. well ppl didn't have anything better to do than call the cops and say that someone in a Porsche is speeding and driving recklessly.. i get into barrow county and there is a cop waiting at the light in the emergency lane.. I am stopped at the light and I see him merge in traffic about 8 or so cars behind.. I slow down a bit, but still weave in and out just not as reckless.. im in a hurry.. after a mile or so, he is way behind and i can barely see him, I see his light go on, but i just think he just got a call..

after a good 5 minutes of him trying to get through the incompetent traffic, he catches up to me; I change lanes to let him by but he gets behind me.. pulls me over, and tells me i was speeding at speeds over 100 and reckless driving.. we talk for awhile, and i tell him i saw him behind me and still did it because I didn't think i was at fault.. three cruisers show up and after running my license (never had a traffic violation recorded) he comes back and asks me if i have "alcohol, drugs, or child pornography" (<- WTF?!? :thinking:) I say no and allow him to search my car.. im thinking, im going to jail, my license is bye bye, and my car is getting impounded.. :eek: he then tells me he is in a good mood and is going to give me a "Too fast for condition" which is pretty much nothing and doesnt go on my record.

I met a lawyer two days ago for something else, and i asked him for this.. he told me that a "too fast for condition" ticket requires the officer to write down the speed i was going, and if the speed is under the speed posted, he needs to give the conditions.. if not, the citation is invalid.. this is one of the best lawyers in GA and he also does part time judge..

I go yesterday to Court in Barrow and tell them the ticket is invalid, and give reasons why, and they say that it is not true, and the citation does not need a speed in order to be valid.. I asked for a continuity, so I got court Nov 6..

SO, What should i do? usually these get dropped, but they wont drop it. it is not sent in to the state and it isn't a moving violation, and no points on my license.. its a BS ticket, but its $131 and i don't want to pay it.. plead "guilty" and talk to the judge, or plead "not guilty".. but if i plead "not guilty", the officer will have to come in, AND, Is it d!ck on my part to plead "not guilty" when he was nice enough to not suspend my license and **** me over?

I would ask your lawyer friend to find the exact clause that states that the officer has to post a speed on the ticket. From what the judge sounded like the first go around, you will definitely need tangible proof to sway him otherwise.

You shouldnt have been driving like ****ing maniac in the first place, and going over 100 miles an hour. Granted I dont know if it was light or heavy traffic. But you still could have killed someone or yourself..

pay the ticket and call it a day

lol pay the ticket - my too fast for conditions was doing 35mph in a 15mph zone and wrecking my car on my own accord - $85 ticket for wrecking my car :lmao: just pay it - insurance really doesn't know about it

i knew someone was going to say this.. :blah: shouldn't be speeding or driving like a maniac.. i dont need to hear that.. and he said i was going over a 100.. i wasnt.. either way, all i retained from that is the useful words, all i need is an opinion on what i should do..

He didnt clock you thats why he didnt give you a ticket not because he was in a good mood.

Everything a cop does is recorded, if his radar detected speeds that fast and he didnt ticket you after pulling over he has a lot of explaining to do to his superiors, especially if something happened that day where they needed his video evidence, and well that kind of stuff happens alot. So he saw you speeding, didnt get any of it on video and didnt clock you so he gave the only ticket that might actually stand up in court. Now if you find the actual clause that confirms what you lawyer says then you can drop that with out even taking it to court, say this "Your honor I move for a dismissal on the ground of clause, yada yada yada"



but you were speeding, you deserve alot more than he gave you, pay your fine of a measly 131 dollars and STFU

well i was also sharing this wonderful story with yall.. for the most part, ive delt with awesome cops.. though sometimes they piss me off how they abuse their powers.. ia has alot of threads with negative feedback on police enforcement.. so here is one with positive feedback.. i really dont care about the ticket, its just that if it really is invalid, why pay it?

that is very true.. he had no video footage, and no way to clock me.. so..

ill also speak with my legal studies TA.. and i would love to pay the fine, but the state is going to get a nice amount of $$ for another fine i got.. so no point in spending more..

^^ if you only knew how many tickets I've decided to pay that either resulted in my keeping my license or speeding or other violations, and my insurance still has no idea because they have all been dropped down to 14mph exact.

My opinion, unless you can have the lawyer bring up the actual clause to fight it, I would pay it if at all possible ( I know you're a bit tight on money ) - worst comes to worst and no clause is found, ask for a payment plan ( you'll be put on a very very light parole thats essentially a monthly payment )

well, are you able to both pay this fine and the other fine as well? If so, if it were me, I would pull up my boots and pay them - I've learned really quick that speeding = $$$$ - in my Starion I had gotten almost 17 tickets in the year and a half I've had it. I've gotten 1 in my Maxima. 2 in my '71 Cuda ( noise violation for open headers and for that unnecessary acceleration thing ). This has been within 2 years time. I could have bought another vehicle with the amount of fines I've paid. So in short, if you can for them all, do it, especially if it doesn't go against your insurance, you have nothing to lose outside of some money, which is a lesson that can be easily swallowed without much reprecussion.

And slow it down some, you're gonna give Porsche owners a bad rep :lmao:

Thanks for the advice :goodjob: Since im 16, ive never had an accident that was my fault. ive been pulled over countless times, got a 90mph in a 65mph which was dropped, and a crossing the gore which was dropped, and a failure to yeild while making a left turn which I plead nolow.. so the only thing i got is failure to yeild..

Until a Month ago, i got 2 speeding tickets (20mph over), this too fast for condition, and another one i don't want to talk about that is serious and by law i should lose my license.. ARGHH!!

im hiring a lawyer, for that serious one, which i also got the speeding with.. my debate is:

a. $1000 lawyer, +fines, will not lose license, speeding lowered but it will most likely go on my record.
b. $4500 lawyer, + fines, one of the best there is, will not lose my license, and there is a "high probability" that it gets dropped..

all i know is that if i get the $4500 lawyer, i will be taking out a loan, not money to spend on my car, and will be eating ramen noodle soup for a while..

To be honest dude.. your under 21.. id pay it.. I had a speeding ticket in which the cop said i was going 85 in a 55 on 285- motorcycle cop. In the situation a- with the heavy traffic at 5pm in the afternoon there was NO WAY I was going 85... a- if i hadnt sped up and went around the vette who decided to slam her breaks because she saw a cop, and the **** ass in an f150 riding my bumper it would have been a nasty accident with me in the middle. I tried to explain this to the cop and he was like.. I dont care... you were going to fast and your under 21.. your going to loose your license.. I went to court.. the judge wiped it off my record as long as I paid $90 and I went to a defensive driving course..

Exactly why you shouldnt be driving what you're driving at that age. Im not hating, just stating a fact. A 16 year old driving this kinda of car is posing a threat to himself and others, whether you want to admit it or not. If you call that hating, then you need to read the above over and over.

"since im 16" means, since the age of 16, 4 years ago.. im 20 now.. i have a perfect driving record and not one accident that was my fault.. that is pretty good,, most teenagers today have horrible records.. me nothing in 4 years, my insurance loves me and my rates are really low.. when i was 16 i drove a 91 accord, then when i turned 17 i bought a prelude, and couple months ago i got the Porsche..

Too fast for conditions is a ZERO POINT offence. I'd just pay it and get over it. You will not loose your license. I've had 2 of them... i'd take too fast for condition over speed or reckless driving anyday..... you're lucky.

And if some 'lawyer' says there has to be a speed... he is outright bull****ting with you. If you are driving the speedlimit in pouring down rain/fog or anything where most drivers should be more cautious, a officer can give you too fast for conditions. It is more of a minor safety violation

I had a ticket like that 35 over, but it was my fault wasnt payin attention. downhill at night cop tailing my ass and BAM lights on. 350 dollar ticket. I just paid.

If you need "advice" as to if you should pay $131 for a ticket you DESERVED which will net you no insurance, points, or any other problem, or spend time and effort to go to court to TRY and get off on a technicallity to a crime YOU ADMIT AND KNOW YOU'RE GUILTY OF and far worse.........you really need some help.

btw, it's a porsche 996 carrera not a 911. so it's not a ridiculously exspensive car. it probably cost as much as your WRX.. maybe a few grand more.

1 - You're lucky as **** that the cop didn't write you anything worse than too fast for conditions... I mean LUCKY.

2 - How ballsy and STUPID of you.... you went into a courtroom and told a judge that the ticket was invalid. PS - NEVER do that. Judges know the law a tiny bit better than you do.. hence the reason you are standing in front of them. Judges tend to be a bit egomaniacal, and nothing pisses them off more than a kid coming in and telling THEM what the definition of valid or invalid is.

3 - Ultimately, it is up to the JUDGE, not you, the officer, or the DA, how ****ty your day is. Don't believe me? I went into court in Statesboro to see a judge about a failure to appear ticket. Turns out my license had been suspended. I didn't know that. The who wrote me the original ticket wasn't present. Stupidly, I asked the judge "So I'm off the hook because he's not here, right?". The judge gets this look and tells me to get out of his court. But before I leave, he asks how I got there that morning. I shrugged and said "I drove..." and he tells me to leave, obviously pissed at something.

A few weeks later I got a ticket in the mail from the judge himself. Apparently when I said "I drove", I had admitted to driving on a suspended license. He wrote me a ticket and dragged me right back into that courtroom. BTW, both of your "lawyers" are very wrong, but that's the kind of lawyer you get in Barrow Co.

Also, "Too fast for conditions" is defined as A driver is considered too fast if the traction conditions do not warrant the speed, they are pushing other drivers, the car goes out of balance on curves and corners, or the vision is not sufficient to make decisions with the available amount of information for the individual's level of attention dedicated to the task.

Note the "they are pushing other drivers". On 316 there is no posted minimum.... so if someone is not going the soeed limit, they are not breaking laws. Also for those of you who are going to say "well it is impeding traffic for slower drivers to be in the left lane". WRONG. The only time is it LEGAL TO PASS when you can WITHOUT EXCEEDING THE SPEED LIMIT.

Jason, its a BS ticket that officers give when they are giving someone a BIG break and not ticketing them for speeding or doing something like that.

This probably went down a lot like the OP posted. He was driving like a moron, someone got pissed and called 911 on him, so they had someone waiting on him up ahead. The cop cut him some slack, yet this genius is still trying to weasel out of by trying to use a technicality.

As I said, I would damn sure take the BS ticket and shut my damn mouth. It would cost me a hellva lot more than $131 on my insurance alone if I got even a 10 over ticket. I'm sure it would cost him a lot more than that since he's not even old enough to drink and probably still on mom and dad's insurance.

It's possible... cops write TFFC when they either don't want to do all the paperwork of a speeding ticket or are feeling especially benevolent. I've gotten TFFC on a perfectly sunny day with zero traffic. Basically the state wants your money but doesn't wanna deal with the time involved to take you to court. Pretty easy peasy ticket.

well i was also sharing this wonderful story with yall.. for the most part, ive delt with awesome cops.. though sometimes they piss me off how they abuse their powers.. ia has alot of threads with negative feedback on police enforcement.. so here is one with positive feedback.. i really dont care about the ticket, its just that if it really is invalid, why pay it?
