to start...im not angel, a couple years back i use to hustle anything.

Today my mother, who lives out of state, answered the door to a police officer beating down the door. He says he looking to serve me(dumpdaccord) papers to appear in court. She tells him she has no way of contacting me and refused to sign the acceptance papers. He told her he will give me until the 20th of this month to contact him or he will "look up my social and summons me."<<<<I dont know what that means

And Im wondering if anybody in here could shed some light on the situation for me.This situation is also in another stae...so how can they summon me?

I know this place is for 'BS' but there is also people here that are more knowledgeable on law than me so just asking for help.:(

any info/knowledge is greatly appreciated.

Didnt say anything about running. I just want to know what kind of actions they will take?

I have a stack of bills that i can barely pay right now and going out of state to possibly be locked up is not really something that is gonna benefit my current situation.

Do NOT contact the police. Do NOT say anything to them. Exercise your rights and keep silent. The cops are not on your side - EVER. They are the accusers, and are not interested in any info that you have UNLESS it will help them convict someone of something (and they hope it's you they convict usually). It does not matter if they "only want to ask you some questions about someone else". That is usually an excuse. If they are serving you with a summons, they have to contact a Marshall's or Sheriff's office where you are and personally serve you. Usually this would be for you to be a witness for a court case, or someone is sueing you for some money owed (such as a credit card company, or similar contract debt). Either way, you shouldn't go out of your way to make it easy for them. If they wanted to arrest you, they wouldn't have a summons, they would have an arrest warrant.
If they do contact you over the phone, and tell you that you have to show or "face charges, consequences, etc.", they are lying. They have to serve you with written notice for a true summons.
Learn your rights, know your rights. Never talk to any cops unless you have a lawyer present.

He's absolutely right. This cop is simply looking for you...they do it this way to try and intimidate you, family or friends into saying something you shouldn't without any kind of legal advice or representation. Don't do anything by phone. If you do communicate at all it should be via a lawyer either in writing or by the lawyer appearing on your behalf to ask what they want. This way they're putting things in writing or speaking to legal counsel and can't twist, reneg or use things against you later. Frankly, a summons could be a lot of things but if it was really serious they would issue an arrest warrent and would would not be "giving you time" to respond.

Sounds like he's hoping you don't know any better and will be scared into seeking him out.

If you can't find any private lawyer, may you should contact Legal Aid and find out if they can be of any help.

Agreed all that cop did was try to shake your mom down for leads as to where you are.

Then summoning statement i have no idea about though.

I would honestly contact a lawyer ASAP and consult him with your situation. Dont go into the story any farther on here or to anyone else for that matter

Dude, if they are trying to serve you with a summons, you're not wanted for any crime... they'd just pull a warrant on your ass and wait until your next traffic stop.

Here are the possibilities:

1. Someone is trying to sue you in civil court... a person, a creditor or whatever.

2. You are wanted as a witness in a civil or criminal court case.

3. You have someone out there that thinks you're her baby daddy.

4. Congress wants you to testify in a hearing.

Regardless of the above, I highly doubt that it was a cop that was trying to serve you... only the Sheriff's office can serve a summons in an official capacity. The city and state police cannot do this. The deputies do not give anyone shit while out serving, it takes too much time and it gets boring after a while. They just want to stop drop and roll. They get paid, paper service or not.

Whomever is summonizing you may be using a private process server... they usually don't get paid unless they serve the defendant/witness. They tend to be a bit more motivated. In some states, they are allowed to carry guns, which may give the impression that they are cops. Sometimes off duty cops do this for extra pocket change.

Wait for them to come to you, who knows what they want.

They can look you up by social, if they have it and run an address check on you, it happens quite frequently and is no big deal. This server is blowing smoke up your mom's ass and telling her that it's foggy outside.

Just relax and ride it out. Noone is going to jail.

well first off a 'summons' is either a citation or a summons to appear, neither is good news.

and your mother should have signed for them, you need to know what kind of papers they were whether it is a subpoena or an existing summons. If you're being cited to appear, you're basically being served civilly or worst case scenario, you've got a bench warrant out for failure to appear. If you're being subpoened, you're usually a witness to something, or something of the like.

How do you become a private process server? lol

Depends, some states and/or municipalities require you to register or get licensed, some you do not have to do anything... I don't know about GA.

+1
When my moms car was stolen and innvolved in a hit and run, the cops assumed it was me. I talked to the cop once, it was funny b.c he tried to make me these deals n shit. He also tried to scare me by throwing the book at me. I got myself a lawyer for pre-indicment charges. I didnt fuck around and went with the best lawyers in GA. I went with Conaway and Strickler. There pricey but what can I say, they have done some high profile cases. Cop hasnt even bothered calling me or bringing me in for questioning.
