so the other day it just got done raining.... i was going up a hill and then around the curve... as soon as i made it around the curve a cop was passing someone and almost hit me head on...I hit the breaks and slid, the cop swirved to get back in her lane and I hit the side rear of the cop car.... Yes they did have their lights on, no siren... I could not see the lights cause i was around a very sharp curve... anyway, I got charged with failure to yield to a emergency vehicle.... WTF? so is there any use in fighting this??? opinions please....

Because when you go to the court date marked on the ticket, its for ARRAIGNMENT!!! It not the fucking trial date. The only way you go to TRIAL is pleading not guilty. Thats when the officer shows up.... and bet your ass they will. They get in trouble if they dont.

You best bet is to go back and take pictures of the section of road to show just how blind the curve is. Take a few pics... like from where you saw him and from where he was when you saw him. Then go to your arrainment and speak with the solicitor and show them the pictures and see if they can chenge it to "too fast for conditions" which is a 0 point and low fine ticket. IT wont even show up to your insurance. Though you might not be guilty, bargaining with them makes it a faster process.... they get their money and you get something that wont bite you in the ass later.

But if they dont want to make any kind of deal.... get a lawyer.

very good information. also i hope u took a bunch of pics of the wreck site and the damage to both cars as well as impact spot. then go back and take pics from the site where u first made visual contact of PC and take pics from the PC perspective as well. good luck i would fight this one. if what u say is ture.

liability will cover the repairs to the other vehicle. repairs to your car will come out of your pocket. go to court and make a deal. you will come out better that way. i posted in iloveboost's thread and you can read the legal stuff there b/c i'm not typing it again.

Yea those things suck. I don't see why the cop would need to drive around the car to push it though, it'll only be in the way. I always knew that the people that represented Wal-Mart weren't the brightest crayon in the box :slap:

Get a Lawyer...this sounds like it wasnt even your fault. Just because he turns on his Lights doesnt mean SHIT! they still have to make sure they can pass safely before going into uncoming traffic...which he/she obviously didnt. If in fact you were unable to see over the hill and the officer was in your lane it was his/her fault. 100% Get a Lawyer! this will hurt your driving record and end up costing you more money for the next 5 years. I would have raised HELL at the scene and they would be paying for the damage

yeah i was with him we was coming around a curve at the top of a mountain she had her blue lights on but not her siren...we could not see her till we came around the curve...by then he couldn't do anything...since he didn't get a ticket he can't take it to traffic court....all he can do is call his insurance and inform them and they will have to fight it...a state trooper came out there to work the wreck, he said if we wouldn't of hit the brakes then we would not of hit her at all...ok he hit the brakes and still hit her, if he wouldn't of hit the brake we would of hit her head on...hunh?

Get pics of the road and try to show on a map what happened- witnesses are great if you can.


But in all honesty i think you should just go ahead and bend over because they are going to try and reem you with not so much as a reach around.

Emergency vehicles still have to abide by the laws of the road. If she was going around a curve without her siren to signal that there was an emergency she was in the wrong. And also you are not under any circumstance suppose to pass another vehicle in a turn. A big no no. Fight it. Tell the judge that it was on a curve. There is no reason that you should have to pay for that. Then sue.

If the cop was in your lane, passing on a blind curve and there was no way for you to see her, you might have a chance in court. If you hit her in the read side of her car it is obvious that she was in your lane and trying to get back in hers. I would put that to the lawyer that you get and see what he says. G/L with that though, it's gonna be tough.

this is pretty easy....first do some research and see how much the ticket would me. Does it outweigh the cost of attorney fees, AND THEN filing a suit againest the county?


Everyone loves to throw lawsuits out there, but have no idea how much it costs and how long it could take.....

so do the math.....which is going to cost you the most....


and

the officer did not have to have the siren on, her lights were on and as most of you know, they are pretty bright, if anything if you take pics of the blind corner and the exact spot where you made contact and bring them to court, the judge could probably just throw the case out

if you have liability then you dont have to pay for their car, you have to pay for your car. thats what liability means. you are liable for damage that you do to another person's property.

tell them to pull the video for court, if there is a video it will prove that you didnt cross the center line on purpose, you might have because you slammed your brakes because a cop was in YOUR LANE, which means she caused you so go into the other lane in wet conditions. If there isnt a video then there definatly was not ANY lights on, their videos always come on when lights are on.

he has to opperate his car with "due reguard" for the safty of the public. If he was passing on a curve in a no passing zone, that's not very safe for you or other people. You neck should have started hurting by now and you should call a laywer.:yes:

In the state of Ga public saftey officials are charged to use Due Regard when running emergency. along with the fact that code 2 is against the law. Code 1= no lights no siren, code 2= lights but no siren ( against ga law) code 3= lights siren, take the dept to court and sue the dog shit out of em.

i am extremely pissed off for you. cops suck at life. you said the cop had a video recorder on right? get a lawyer immediately. the longer you wait, the more it hurts your odds. sue them to pay for your car. and then filing a false police report if that video shows the cop was passing on a curve and hit you. i really hope you get this settled in your favor. im sick and tired of cops taking advantage of the public

i talked to my insurance company this week and they are supposed to "take care" of it for me... I guess they will settle with the police insurance... I took pictures of where it happened today so i will post them up later, im gonna send them to my insurance company tomorrow

so now the insurance company has gotten the video and the police report and everything.... I come home today and there is a message on the answering machine from the police dept wanting me to call him at 7:30am in regards to the accident. So im wondering what this could be about??

dude if someone calls you asking your side of the story, dont talk to ANYONE! tell them to speak with your insurance company.... i've had times where i was in an accident (not at fault) where i got a phone call from the other persons insurance asking me to tell my side of the story... all they do with that is twist your words to give them a fighting chance to get out of being liable. give every peice of evidence to YOUR insurance co, as they're on YOUR side... believe me, they would rather NOT pay to repair an officer's vehicle...

that doesn't make any sense....how can you be charged with anything without a citation? a police report is just a cliff notes of the incident....it might have been *noted that you crossed lanes, but you can't be charged with it on a report....if you get charged with anything, you will be given a citation which you will sign for acknowledging what the officer is "charging" you with.

so they didn't charge you with anything then....it was noted in the police report...you need to go back and re-read the report, because if they said they charged you then you would have a citation, and you do not have one, then you are clearly in the safe zone....this is probably why your insurance company is handling this and not you personally....apparently there is some paperwork foul up and it works out in your behalf....but being charged with anything you will receive some sort of documentation stating what you are being charged with, not just a police report

typical accident:

someone follows too closely, and hits the person in front of them at a red light.

they would be "charged" with following too closely and receive the citation, as well as receiving a copy of the accident report which would note you being charged with following too closely

Every officer in a marked partol car should have an in-car camera and the video is ALWAYS public accessible, talk to her superviser...seriously, [you should have done this that day] tell him exactly what you said in the original post and ask to review the tape with her supervisor/captain.

Most likely since they were involved in an accident the supervisor has already seen it but you have to talk to them. If it happened as you said then someone has desk duty or be directing traffic for funerals and schools for a few months...

Hell I think your screawed, one time I was pulled over on the side of the road and a cop rearended me, I was like wtf, the proceded to get out and give me a ticket for improper backing.
I got a lawyer and it still stuck. Hell I pulled over about to get out and get my dog that had gotten out of the back yard.

Prepaid legal only works if you plan to plead guilty to everything you are ever charged with.
We received it through the company that I previously worked for as a "perk". Waste of money, and screwed over some collegues of mine.

They manned the phone lines with telemarketers-turned-paralegals that were there for one thing - to up-sell you on "services". Basically, to get ANYTHING, you have to pay them twice. And then you get a rookie lawyer that knows less about the law than I do.

If you need a lwyer, hire one outright when you need it. Don't pay upfront first. If you do, they have no motivation to help you when you do need it - they already got paid.
