Court Hears Appeal in Teen Oral Sex Case

ATLANTA (AP) - In 2003, 17-year-old Genarlow Wilson was an honors student, standout athlete and homecoming king preparing for his SATs with an eye toward college. But that all changed after a New Year's Eve party involving alcohol, marijuana and sex.

Wilson, now 21, is serving 10 years without the possibility of parole after a jury found him guilty of aggravated child molestation for having consensual oral sex with a 15-year-old girl that night. He was charged with rape for being one of several male partygoers to have sex with a 17-year-old girl, but was acquitted.

Wilson's sentence has been widely criticized, even by members of the jury that convicted him and the author of the 1995 law that put him behind bars.

"The law was designed to protect kids against really, really bad people doing very bad things," said the sponsor, former state Rep. Matt Towery, a Republican. "It was never intended to put kids in jail for oral sex."

Wilson, clad in a white prison uniform, watched the hearing begin Wednesday morning. His legal team will again try to free their client as a Monroe County Court hears a claim that Wilson's constitutional rights are being violated.

The lawyers will argue that his legal counsel during his 2005 trial was ineffective. Among other things, his lawyer did not subpoena the 15-year-old to testify. The petition also argues that the sentence was grossly disproportionate.

Wilson's appellate lawyer, B.J. Bernstein, compared the case to the recent rape case involving Duke University lacrosse players, saying prosecutors in both cases overreached.

Wilson has served more than 27 months in prison. His case has become something of a cause celebre, largely because of the legal loophole that ensnared him.

If Wilson had had sexual intercourse with the 15-year-old he would have fallen under Georgia's "Romeo and Juliet" exception. But under the law in 2003, oral sex between teens constituted aggravated child molestation and carried a mandatory sentence.

Wilson's case shows how a law designed to go after child sex predators can have unintended consequences and criminalize consensual sexual activity between teens, said Karen Worthington, director of the Barton Child Law and Policy Clinic at Emory Law School.

Georgia lawmakers in 2006 changed the law to make consensual oral sex between teens a misdemeanor punishable by a maximum of one year behind bars. Offenders do not have to register as sex offenders, as Wilson will be required to do.

But the state's top court ruled the 2006 change couldn't be applied retroactively to Wilson's case. An attempt earlier this year to pass a bill that would provide a remedy for Wilson has stalled.

The effort was complicated by a homemade videotape showing the New Year's Eve party. On it, a 15-year-old girl can be seen performing oral sex on Wilson. It also shows Wilson and other male partygoers having sexual intercourse with the 17-year-old.

Prosecutors argued that the 17-year-old was semiconscious and not capable of consent. But a jury that watched the tape disagreed and acquitted Wilson of the rape charges.

Despite that acquittal, Douglas County District David McDade told WXIA-TV in March that "six young men basically gang raped a 17-year-old." McDade did not return a phone call from The Associated Press seeking comment.

Wilson's most vocal critic has been Georgia's top Republican senator, Eric Johnson, of Savannah.

"This was not two star-crossed lovers on a date," Johnson wrote in an opinion piece opposing the bill written to help Wilson.

The five other male partygoers took plea deals. Wilson's case was the only one that went to trial.

it is so fucking retarded how our justice system and laws that we live by have become a quagmire of words and semantics...what ever happened to just admitting if something is right or wrong, regardless of WORDS that have been put into a book somewhere?

Not that the justice system isn't bullshit, but where is that line of right and wrong? Kind of why we have to keep records, make rules etc.

Common sense is where the line should be at.

What many people don't know is that in the State of Georgia the CONSTITUTION clearly says that a jury is supposed to judge based on two things: THEIR interpretation of the law and the facts. The key word there being INTERPRETATION. No judge ever reads that as part of his/her instructions to the jury. Therefore the jurors think that what the judge/lawyer tells them IS the law just IS, no room for common sense in their minds just judging based on facts presented in the case. That is just wrong not only legally, but also morally.

This kid doesn't belong in jail at all. He had consentual sex with someone basically his own age, both minors. Just because she suddenly regretted doing it because there was video of her acting like a ho doesn't change the fact that she consented to it to begin with. According to people that have seen the video itself, she never once said "no". So what's the big hoopla about that? Didn't we all do that when we were 15-17? Why is it suddenly that this guy has to be labeled a child molestor for the rest of his life over it?

It's not right IMO.

His friends took the plea bargain and 5yrs but he didn't want to be considered a registered sex offender and tried to fight it...wound up handing him his ass with a 10yr sentence instead! :no:

If its the same guy who went to UWGA, his story was on 60min or something too! Sucks for him.......

His friends took the plea bargain and 5yrs but he didn't want to be considered a registered sex offender and tried to fight it...wound up handing him his ass with a 10yr sentence instead!

Not sure, but it sounds a lot like this one. He's already been acquitted of rape for the 17 yr old they all had sex with. He's only been convicted of the 15 yr old giving him head.

The sad part is that even the jurors said it wasn't fair but they had to follow the "law", which again goes into what I mentioned earlier about they weren't told they could INTERPRET the law only follow it which is wrong. We should be able to make common sense judgment when being a juror. The laws are designed to give everyone a fair shake, right? So why is it that jurors can't be fair about their judgment?

Yes its the same guy. Shortly after he was convicted the law was ammended to prevent this from happening again, however the courts refused to reverse the sentence even though it was clearly unfair. Even worse was the fact that the DA had such a weak rape charge against Wilson that they tacked on the child molestation charge to insure some form of conviction.

They made it so it wasn't a post facto law - as in, "Okay this is the law now, but that doesn't apply to this kid."

Yea i have been watching this case since it happened. Just sad that it happened that way.i think it shouldnt be punishable at all, he was 2 years older then her and he didnt force her to preform oral sex.
Also under the law you not considered an adult till 18, u cant even go fight in wars or vote till 18 when u a legal adult why should this be diffrent!

It's not right IMO.
If you saw my first post you would see that I agree. "Common sense" or "what's right" is a weak argument because at one point it was "common sense" that African Americans and Women (among others) had no place in advanced society (voting, careers etc.).

This decision was made out of prejudice...(or "common sense" to racists).
