so my GF was working at this restourant for 2 months, and after a bunch of talking about her paycheck she got paid for one week (after a 5 weeks working already). Then she had problems with the next paycheck as well, so we had to go and chase the owner again, and she got paid for another 2 weeks, at which point she stopped working anymore due to obvious reasons. It's been a week since she's not at work anymore, and we went to pick up money (for the rest 5 weeks), and with pain we got a check only for one week again, which leaves the remaining 4 weeks unpaid.
Now he is saying that he's having problems, but at the same time almost all other employees get paid (about 6 of 'um), and they are building another restourant at the same time.
what should we do, considering the fact that when my GF started working, they delayed her emoloyment papers, so she hasn't filled up any and we suspect that she's been off the payroll on purpose ... All he said was "check back next Friday, and she (my GF) maybe will have a check again.
- make a pain for them by calling the healt department, cause the restourant is dirty as shit, and cockroaches are moving on the plots ... so they get closed down for a while. Or threten them that we're gonna do that ?
- Tell 'um that we're gonna call the labor department, which would be a bigger pain for them to deal with, eventhough my GF is not technically being employed
- beat up the guy somewhere, take his wife/son as a hostage, LMAO
- start doind damage to the place little by little, as somebody else did before by throwing a rock and smashing the front window (last week)
???
what would you do ?

I don't get it. Why would you continue to work somewhere while not being paid or without filling out legally required payroll forms?

Call the labor department, keep the conversation short and to the point, details are not important just tell them exactly what happened. He does not want an audit from the labor department.

If they in fact haven't had any papers for you to sign(verification of employment, tax forms, etc,) you have no leg to stand on.
They'll ask for your g/f verify that she's employed there, and she won't be able to (on paper)
I hope they paid your g/f in checks or another form of payment traceable back to the employer and not in cash.

Exactly.
There are pretty strict labor requirements depending on how she was employed. Did she punch a clock? Did she work for tips? Were taxes taken out? Did you fill out employment forms?
There are lots of avenues you can take. The labor dept would be my first choice, but you'd better be ready to tell them EXACTLY how much she worked and how much she's owed. You don't want to call the labor dept. to file a complaint and not be ready. You will likely not be taken as seriously.

Seriously, if she got a check from either him or the business, report it to the DOL and then report his ass to the IRS... audits from either of them will fuck him up more then you ever can.... and it will be done legally.
though you should be -1 repped for going on about doing something illegal.... because then he can fuck you up legally, what good would that do?

alrighty, so you can nail him good..... thats paying someone 'under the table' unless she got a stub showing taxes being taken out. Chances are she didnt though..... so get on the phone and report his ass already.
Oh and dont cash them yet.

nop. She got less money because he said that those were for taxes, but my GF did not get any proof of that.

how much did he pay her total.. cause if it is not over 500 the employer does not have to pay taxes on it or report it. and the irs wont do shit about it.
